1、Samsung Electronics Global Human Rights PrinciplesFebruary 2023Global Human Rights PrinciplesHuman rights are the fundamental rights and freedoms that are inherent to all human beings.Samsung Electronics Co.,Ltd.(hereinafter“Samsung”,“Company”,“we”)is committed to integrate the basic yet fundamental

2、 principle that human rights belong to all people into its values and business activities across the globe.Our CommitmentSamsungs Global Human Rights Principles(the“Policy”)formalizes our commitment to respect all humanrights and labour standards which are reflected in international principles and s

3、tandards including theInternational Bill of Human Rights(composed of the Universal Declaration of Human Rights,the InternationalCovenant on Civil and Political Rights,and the International Covenant on Economic,Social,and CulturalRights),the International Labour Organizations(ILO)Declaration on Funda

4、mental Rights and Principles atWork,the UN Guiding Principles on Business and Human Rights(UNGPs),the OECD Guidelines forMultinational Enterprises as well as the UN Convention on the Rights of the Child,the Convention on theElimination of All Forms of Discrimination Against Women(CEDAW),UN Protocol

5、to Prevent,Suppress andPunish Trafficking in Persons and,at a minimum,the laws of the countries in which we operate.WhereSamsung faces conflicts between internationally recognized human rights and national laws,including incaseswherenationallawdoesexplicitlyprohibitadherencetocorelabourstandards,the

6、companywillfollowprocessesthatseekwaystohonourthehigheststandard.As a signatory of the UN Global Compact(UNGC),the worlds largest corporate sustainability initiative,and amember of the Responsible Business Alliance(RBA),an industry coalition dedicated to corporate socialresponsibility in global supp

7、ly chains,we apply the 10 principles set forth in the UNGC within and across ourbusiness,strategies,company culture,andmanagement practicesandcommittotheRBACodeofConduct.We operate across vast geographies,including in locations where social,economic and political factors mayput human rights and dece

8、nt working conditions at risk.We believe that respect for human rights is the bestfoundation to run our operations and that it adds value to our company.We also recognize the importantresponsibility we have as a company in this regard and are therefore committed to respect human rightsacrossallourbu

9、sinessactivities,includingtheproductsandservicesweprovide,toliveuptoourcommitmentto do no harm and to promote human rights where we can have a positive impact within our sphere of ourinfluence.We are committed to making our best effort to not be complicit in or cause any human rightsviolations and t

10、o respect the human rights of every individual or group connected to our business-withparticular care for vulnerable and marginalized groups who may be impacted by our activities includingmigrant and young workers,disabled people,women as well as disadvantaged groups,and underconsideration of high r

11、isk contexts.This accounts for our own business activities,and we hold our suppliersand partners to this same high standard.We commit to continually update and improve our human rightsapproachinlinewiththespiritoftheUNGPs.This policy applies worldwide to Samsung and to all its entities including our

12、 own factories and othersubsidiaries,all its permanent employees and contingent workers,our products and services as well as ourbusiness relationships including our supply chain,third-party contractors and subcontractors,partners,resellers and other relevant stakeholders including our customers,prod

13、uct end-users and communities.Samsung also expects its suppliers and other business partners to uphold these principles,including toprevent,mitigate and address adverse human rights impacts,and strongly encourages them to adopt thesameorsimilarstandardsandpolicieswithintheirownbusinesses.Samsung Ele

14、ctronics Global Human Rights Principles1/6Samsungstrivestoprioritizethemanagementofthehumanrightsimpactsofourbusinessactivitiesbasedonour business relationships,the operational context,our leverage and severity.We recognize that prioritiesmay change over time and therefore regularly review our focus

15、 areas.Our work is organized around oursalient human rights risks,which we have identified through our continuous engagement with internal andexternal stakeholders,internal assessments,third party audits,grievance channels and human rights riskandimpactassessments:Working hours and the right to an a

16、dequate standard of livingSamsung recognizes the right to rest and leisure and commits to follow applicable local laws and regulations withregard to working hours and overtime.Samsung commits to the ILO Convention C001 for a regular workweek,C014as well as C106 on working hours and rest.All overtime

17、 must be voluntary and paid at a premium rate as per locallaw.Workersshallbeprovidedsufficientrestincludingbreaks,restbetweenshifts,holiday,andallowedatleastoneday off every seven days.Samsung acknowledges the link between working hours and an adequate standard ofliving and is therefore committed to

18、 provide remuneration for a regular work week which satisfies workers basicneedsandthoseofthemembersoftheirfamilywhoaredirectlydependentonthem.Employeecompensationispaid,ataminimum,incompliance withapplicable wage laws,includingthoserelatedtominimumwages,overtime hours,and legally mandated benefits.

19、There shall be no unlawful deductions taken from workers wages;where legitimatewage deductions are made workers shall be properly informed.Samsung expects its suppliers to abide by the samestandards.Salient Human Rights RisksPrevention of forced and child labourSamsung recognizes the risk of both fo

20、rced and child labour especially in the lower tiers of its supply chain.Weprohibit any form of child labour and forced labour,and expect our suppliers to share our commitment to conductthorough due diligence to address risks,including age verification checks.Identified cases are handled with extraca

21、re and according to internal protocols with the aim to provide remediation and reinstate the rights of affectedindividuals.Samsung commitsto the Employer Pays Principle and actively monitors and works with its supply chainpartners to prevent the payment of recruitment fees by workers and the occurre

22、nce of other ILO forced labourindicators.Where infringements do occur,immediate action is taken,where applicable in collaboration withsuppliers,to rectify issues including the repayment of recruitment fees.Special protection is provided for youngworkers which should not perform hazardous work,overti

23、me,or night shift work.Samsung works with variousstakeholders,has partnerships and programs to address root causes and existing risks,including programs onhelping young people to find meaningful employment to address the cycle of poverty as one of the root-causes ofchildlabour.Freedom of association

24、 and collective bargainingSamsung recognizesthe right ofitsownand businesspartners employees toformand jointradeunions oftheir ownchoosing,to bargain collectively,and to engage in peaceful assembly,as well as the right to refrain from suchactivities.Samsung commits to refrain from any interference w

25、hich would restrict this right or impede the lawfulexercise thereof,which includes that the discrimination of workers for forming or participating in a union is strictlyprohibited.Samsung recognizesthatthe rightto freedom ofexpression and ofassociation are essential tosustainedprogressandencourages

26、itsemployees toexpresstheirviews,concerns,andsuggestionsopenlywithoutreprisal.Occupational health and safetySamsung is committed to providing a safe and healthy workplace environment for its employees,contractors andother business partners in compliance with health laws and regulations,as well as in

27、ternal requirements.We arecommitted to eliminating the risk of any harm to people from all our activities,and to keep people healthy.Thisincludeseffortstoreduce riskstopeoples health duetointernal and external factorssuchaswork accidents,injury,health impacts(including mental health)and pandemics as

28、 well as emergency response systems in the event ofexternal safety concerns including natural disasters.Robust internal management systems and emergencyresponsesystemsare inplacetoprotectour people.PPEsareprovidedtoour employees at nocostand OHStrainingis provided on a regular basis to secure a safe

29、 working environment.Employees have the right to and freedom fromretaliationincasetheyleavetheirworkplacebecausetheyfeel theyareindanger.2/6Samsung Electronics Global Human Rights PrinciplesNon-discrimination and diversitySamsung is committed to a diverse and inclusive workplace which is free from a

30、ny type of discrimination in its ownoperations and places importance on the same values for the partners we do business with.We are committed topromote equal opportunities for all applicants and employees throughout the entire lifecycle of an employmentrelationship,including gender equality and effo

31、rts to empower female workers.Any type of discrimination on thebasis ofage,disability,ethnicity,sex,gender,race,color,religion,nationality,sexual orientation,union membershiporanyotherstatusisstrictlyprohibitedandwontbetolerated.Anti-harassmentSamsung employees are expected to treat its co-workers a

32、nd all its business partners with dignity and respect.Allforms of harassmentincluding sexual harassment,violence,disrespectful and inappropriate behavior,retaliationor corporal punishmentare strictly prohibited,including harassment on the basis of discrimination against peoplewith protected characte

33、ristics such as age,disability,ethnicity,sex,gender,race,color,religion,nationality,sexualorientation,unionmembershiporanyotherstatus.Product responsibility including AI EthicsInnovative technologies are created to positively transform our society but can result in negative side effects due totheir

34、design and potential misuse contrary to their originally intent.Samsung seeks to understand potential humanrights risks prior and during product development by carrying out due diligence in responsible product design,primarily through our AI Ethics Council,AI Principles of fairness,transparency and

35、accountability and supportingtraining and partnerships related to artificial intelligence to fulfil our social and ethical responsibilities.Members ofthe public including communities and end-consumers,particularly those being at higher risk such as children anddisabled persons,are also entitled to n

36、ot experience harm through our business activities and products.Samsungcommitstoupholdtheirrightsaccordinglyanddoesnottolerateanymisuseofourproducts.Digital responsibility including Privacy and Freedom of ExpressionSamsung is committed tothe right to privacy and freedom of expression and strives to

37、protect against unauthorizedaccess,storage,use,destruction,modification,ordisclosureofpersonal information anddataforitsownemployees,business partners as well as its end consumers.All of Samsungs products and services are delivered in compliancewith its Privacy Protection Principles including transp

38、arency,security and choice and its country-specific GlobalPrivacy Policy,which reflects the respective countrys laws and regulations,to safeguard the privacy of ourconsumers globally.Our approach is to provide products and services enabling free expression,access toinformation and exchange of ideas

39、that wont enable customers,including governments,to bypass or compromisesecurityfeaturestobeusedtosurveilorinterceptcommunicationsorotherwise limittherighttofreeexpression.Environmental ResponsibilitySamsung acknowledges that climate change is a serious environmental,economic and social challenge an

40、drecognizes the right to a clean,healthy,and sustainable environment as a universal human right.Samsungsenvironmental strategy is aiming to address environmental risks emerging out of its product operation and use byreducing emissions,applying new sustainability practices and the development of inno

41、vative technologies andproducts to contribute to a just transition and to address risks to communities and people such as waste,emissionsandwateruseandpollution.Supplier Responsibility including Responsible Mineral SourcingWhile the majority of our products are being produced in-house,we are aware t

42、hat much of the risk,especially ofmore severe violations,are prevalent in the lower tiers of our supply chain.In our efforts to manage those risks andengagewithoursuppliers,weapplyanintegratedworkenvironmentmanagementprocesstocheckandmonitortheimplementation of our Supplier Code of Conduct.We priori

43、tize key suppliers inconflict-affected and high-riskareas,and particular focus is given to the most salient risks including in the areas of forced and child labour,risks tomigrantworkers,health andsafetystandards,environment,hoursofwork andwagesaswellasresponsible mineralmanagement.Samsung has estab

44、lished a conflict-free minerals management system based on the OECD DueDiligence Guidance for Responsible Supply Chains of Minerals from Conflict-Affected and High-Risk Areas andworks with dedicated initiatives including the RBA Responsible Minerals Initiative(RMI)to address challenges ontheground.3

45、/6Samsung Electronics Global Human Rights PrinciplesBased on the United Nations Guiding Principles on Business and Human Rights(UNGPs),Samsung hasformally established the following Labour and Human Rights Framework,providing an integrated workingmodel to manage our human rights due diligence process

46、 in a holistic manner within and beyond theorganization,embedding key steps to identify,prevent and mitigate human rights risk factors andinfringements acrossourbusinessoperations andrelationships:Human rights policyAll of Samsungs human rights-related policies(overview referenced below)are an expre

47、ssion of ourpublic and top management commitment to meet our responsibility to respect and supportinternationally recognized human rights standards in which we stipulate our expectations of personnel,businesspartnersand otherrelevantparties andhowweplantoimplementthesecommitments.Policiesare based o

48、n international standards and its development and amendments are informed by a holisticassessment of risks,internal needs and industry developments and follows a process of internalawareness raising activities to support its implementation and external communication to stakeholderstoincrease transpa

49、rency andaccountability.Implementation of our Human Rights CommitmentsHuman rights trainingThrough regular human rights training targeted to the specific functions and levels across theorganization,we disseminate to all employees the importance of human rights,educate employees ontheir rights,on the

50、 companys efforts to respect the rights of employees,and the actions to be taken toprevent infringements and manage human rights violations.By providing training to our own employeesandselectedsupplychainpartnersweaimtopromoteawareness andbuildaculturewherehumanrightsbecome anintegralpartofourbusine

51、ssandcompany cultureaswellasthatofourbusinesspartners.4/6Human rights due diligenceBasedontheprinciple ofcontinuous improvement,Samsunghasconductedregularand on-goinghumanrights due diligence since 2013,taking into account constantly changing internal and external businessenvironments,andiscommitted

52、 tocontinuing todosointhefuture.Ourapproachincludes:Assessing the potential and actual adverse risk of our business operations to individuals and groups beingimpacted by our operations through a variety of measures including engagement with internal and externalstakeholders,assessments and targeted

53、investigations leaning on methodologies of the Responsible BusinessAlliance(RBA)by our internal human rights teams,RBA third-party audits and external party-lead humanrightsriskandimpactassessments inhigh-impactmarketsoronsalientissueswhereourleverageishigh;Prioritizing risks and implementing steps

54、to close gaps and findings accordingly across the organization viashort-,medium-and long-term actions plans,dedicated internal programs and other measures,includingmeasurestopreventreoccurrence;Identifying if measures taken are effective and lead to prevention of harm and a positive outcome bymonito

55、ring the implementation of our policies via impact assessments and third-party audits and takingcorrectivemeasures,where necessary;Extend our human rights due diligence practices to our business partners,including our service providers andsuppliers from whom we strive to source responsibly from.Towa

56、rds this end,we operate a managementprocess and system build on our Supplier Code of Conduct principles which introduces an assessment ofsuppliers human rights performance prior to doing business,an pathway to close gaps,capacity buildingsupport to enhance management system capabilities,continuous i

57、nternal and third-party verification of theirperformance,andincentivesforgoodhumanrightsperformance;and,Regularly review,update and extend our management system,processes and scope according to findings andinlinewithexternaldevelopmentsandasbestpracticeevolves.Samsung Electronics Global Human Rights

58、 PrinciplesAccess to remedySamsung is committed to perform thorough due diligence to prevent direct or indirect complicity in human rightsviolations in its business operations.Where infringements have occurred and individuals or groups haveexperienced actual adverse impacts caused or directly contri

59、buted by us,whether wholly or in part through ouractions or inactions,we commit to promptly investigate allegations and provide effective and satisfactory access toremedy,by ourselves and/or in cooperation with other stakeholders.Serious cases are escalated to and discussedwith our senior leadership

60、 level.To prevent reoccurrence,Samsung will investigate root-causes and apply changesto systems,processes and practices as needed.Samsung also expects its suppliers to provide or cooperate in theremediation for workers or other affected individuals,where the supplier has caused or contributed to adv

61、erseimpacts.Samsung will work,within reason,with suppliers and other business partners on remediatinginfringements,providing guidance and support where linked to Samsung business.Samsung provides a range ofgrievance and feedback channels in the spirit of the UNGPs effectiveness criteria,including ti

62、mely follow-up,keeping complainants informed of the progress of their grievance and,provide the opportunity to appeal,andexpects suppliers and partners to do so as well.Those channels are open to internal and external stakeholdersincluding supply chain workers,civil society and other concerned stake

63、holders.While most of our channels areoperated on corporate level,we also partner with third-party organizations in selected countries to provideadditional channels to our employees.We understand grievance channels as complementary to our eco-system ofother engagement fora which we operate,including

64、 our yearly employee temperature check survey andengagementsviaworkscouncils,unions,committeesandotherengagementmeetings.Samsungprohibitstheuseofretaliation of any form against workers or stakeholders,and is committed to cooperate with-and not obstructparticipation(ofworkers orotherstakeholders)inor

65、theoutcomeof-judicialandnon-judicialmechanisms.Transparent disclosureSamsung regularly publicly discloses and communicates,both internally and externally,through a variety ofdifferent channels on how we fulfil our responsibility to respect human rights,our policy commitments and whatactions we have

66、taken to improve and strengthen our human rights work.This creates corporate accountabilitytowards our internal and external stakeholders and a feedback loop with our external stakeholders who assess ourinformationandengagewithus,supportingoureffortstoimproveourperformance.Stakeholder engagementWe r

67、ecognize that we are part of an eco-system in which we operate and that we have an impact on its people andtheir communities.As part of our efforts to advance human rights within our business operations,we are thereforecommitted towards open,active and direct communication with our stakeholders.Towa

68、rds this end,wecommunicate with a wide range of relevant stakeholders including those who may be affected by our activesincluding our own employees,suppliers,communities,customers,shareholder,governments,investors,international organizations and civil society actors to listen to,engage with and lear

70、equire a collaborative effort and innovation.Rights-holders such as our own and supply chain workers and vulnerable groups including but not limited to migrantworkers are involved directly or via legitimate representatives in selected projects,through audit and(impact)assessment interviews and throu

73、ronmental protection.The scope of subjects to be discussed at the Boardincludes Samsungs own operations as well as its supply chain.Under the CEOs chair,the SustainabilityManagement Council consisting of key executives which meets at least biannually has been established topromote sustainable manage

74、ment.Our Global Labor and Human Rights Committee of executives andworking-level officers from eight functional organizations*within the company discuss human rightsmatters on a monthly basis.Of the matters discussed,we put forward priority matters to the SustainabilityManagement Council for decision

75、s at the key management level.Multiple teams across the organization,including experienced senior human rights professionals,are responsible for managing the day-to-dayresponsibilities of implementing this policy and ensure that breaches as well as gaps are addressedaccordingly withinourownoperation
